Mental capacity

We have over 20 years of experience in working with children and adults who, for a variety of reasons, have lost mental capacity, meaning that they are unable to make decisions for themselves. In many cases, acting as their Financial Deputy, we manage our clients’ financial affairs on their behalf under the rules and regulations set out by the Court of Protection. We work closely with our clients’ families, carers and advisors to ensure that their finances are managed appropriately, day-to-day and one-off payments are handled and long term investments are protected. In addition, where an individual has requested to become an appointed deputy, we can also provide a service to prepare all necessary application papers to obtain the appointment. Our empathetic and personal approach to this area of work has resulted in our clients liking us, valuing us and staying loyal to us.

Lasting Powers of Attorney (LPAs) are documents which hand over some or all decision making to one or more individuals who can act on the client’s behalf where there may be need to do so. There are two types of LPA; ‘Property and Finance’ and ‘Health and Welfare’. Where an individual has capacity, they may use the LPA to allow decisions to be made in their absence (for example, when on holiday) or at any time when they are unable to do so personally. In situations where the individual is deemed to have lost mental capacity, the LPAs ensure that appropriate decisions can be made on his or her behalf. Clients can choose to have one or both types of LPA depending on their circumstances and preferences. For more information about LPAs please get in touch with us.

Please contact us if you would like an initial discussion about any of our services in respect of mental capacity.
